    Los derechos de los adultos mayores y el control de convencionalidad en el Ecuador

    The analysis of the topic arises because older adults have commonly been considered another burden for society, they have become the object of mistreatment and discrimination, for this reason, the objective was: to analyze the way in which conventionality control is applied to guarantee the rights of older adults. The methodology followed an eminently qualitative approach through the collection of data, with the review of judicial resolutions referring to the elderly and the control of conventionality, the method was deductive with an approach from the general to the particular, in addition the interview technique was used. Aimed at judges and legal professionals, another resource was bibliographic files and mnemonic files. Regarding the results, it was obtained that the interviewees identified a series of rights that they consider violated on a recurring basis, one of them is the lack of care and protection, lack of medical care, discrimination in employment, poor access to services and others benefits; They highlight that this type of control is the most relevant and effective in the country, in addition, concentrated control is the main approach to guarantee that internal standards are aligned with international regulations. It is concluded that the rights of older adults are supported by international treaties and conventions, which establish a solid legal framework that seeks to eliminate barriers and discrimination, promoting active participation in society, guaranteeing access to essential services through recognition of their rights

    La contravención del maltrato y muerte de mascotas y animales de compañía y el principio de proporcionalidad

    The research carried out has as its theme “THE CONTRAVENTION OF MALTREATMENT AND DEATH OF PETS AND ANIMALS OF THE COMPANY AND THE PRINCIPLE OF PROPORTIONALITY”. This work exposes the complex reality of mistreatment and death of pets and companion animals, the increase in sanctions issued for animal abuse in Ecuador in the last year indicate that one in four people mistreat animals in the city, in this respect a series of debates have been generated with the purpose of eliminating the practices related to the animal abuse, diverse social sectors have promulgated actions to guarantee the respect and the generation of suitable conditions of life for the pets and pet animals in base to the legal frame in force , despite being a violation whose sanctions seek to change the behavior of abuse, abuse, exploitation, cruel treatment, signs of hatred by society, these behaviors against animals have been normalized, which has made it impossible to execute effectively the sanctions, before which arises the need to toughen sanctions and guarantee the principle of proportionality. The investigation allowed through a field study through the use of a survey applied to 188 subjects made up of Natural Persons, Staff of the Municipal Shelter of Ambato, Environmental Attorneys in Free Practice of the City of Ambato, Officials of the Ministry of the Environment and Animal Protection NGOs, who agree that animals do not enjoy the rights that the Constitution must guarantee them, there is no good perception of the effectiveness of legal guarantees on animal abuse, the statistical data reflect the perception of disinterest and lack of co responsibility on the part of the State on the mistreatment and death of the animals, in addition a global perception is denoted where it is stated that the offenders of the contravention of mistreatment and death of companion animals and pets do not receive a sanction according to their infraction , finally it is concluded according to the results of the investigation that there is a totalitarian agreement the need to include a criminal offense within the COIP that describes serious behaviors that undermine the rights of animals.

    Maltrato Institucional de Niños y Niñas en el Hogar Santa Marianita de la Cuidad de Ambato, Provincia de Tungurahua durante el periodo Junio-Diciembre del 2009.

    Una de las dificultades más importantes con relación al maltrato institucional es el hecho de que muchos profesionales viven en déficits como algo normal, como un hecho cotidiano, y no se les otorga el valor que realmente tienen. Sin embargo, nosotros no podemos aceptar el conformismo en estas situaciones y si, a pesar de los mecanismos de prevención del maltrato institucional no se puede evitar, tenemos que implicarnos. No podemos mostrarnos pasivos, ya que también formaremos parte de este maltrato de forma encubierta (por omisión), estaremos llevando a cabo maltrato institucional y nos convertiremos en maltratadores de una forma u otra, evidentemente con diferentes grados de responsabilidad. No se trata de angustiarnos, de dejar de trabajar o de sentirnos impotentes, se trata de informar adecuadamente a las instituciones para sensibilizarlas, hacer comentarios con los compañeros sin miedo, hacer patentes y públicas las anomalías a las entidades responsables desde la institución en la que trabajamos (reuniones, informes, memorias, etc.). Y si la importancia lo justifica y lo merece, tenemos que buscar los canales para que estos hechos trasciendan en el día a día, a través de estamentos como el mismo colegio profesional (tendría que dotarse de mecanismos para hacer frente a este tipo de maltrato), otros colectivos ciudadanos o informando a la opinión pública, pero evitando sensacionalismos que no ayudarán a resolver el problema. El realismo en la práctica del educador y de la educadora social se ha de entender como una búsqueda continua de alternativas y de soluciones reales, pero nunca como una aceptación ciega o resignación, y menos ante la detección y la práctica de un maltrato institucional. En este sentido, cualquier tipo de explotación, especialmente aquellas que la sociedad tradicionalmente ha considerado como “males menores” y que en mayor o menor grado ha permitido, es un área ante la cual ningún profesional debe quedarse callado.
