    Vida laboral de la mujer académica en la presencialidad

    The professional life of female academics in face to face settings is a topic of growing interest today, given the context of gender equality and the pursuit of work life balance. This thesis investigates the experiences of female academics in face to face environments, focusing on the challenges they face and the strategies they employ to manage their work and family life. One of the main challenges faced by female academics in face to face settings is the lack of strong institutional policies supporting flexibility in work schedules and childcare centers. The TechnicalUniversity of Ambato lacks childcare facilities on all its campuses, making it difficult for female academics to reconcile their work and family responsibilities. Additionally, female academics often face additional pressures to meet expectations of productivity and academic excellence. Thispressure can lead to increased stress and burnout, especially when combined with family responsibilities. To address these challenges, female academics employ a variety of time management and family care strategies. These strategies include careful scheduling, negotiating roles and responsibilities with their partners, seeking support from colleagues and external supportnetworks, and establishing clear boundaries between work and personal life. The research also reveals the importance of support networks in the professional lives of female academics. Colleague and friend networks can provide a space for sharing experiences and coping strategies,as well as a place to seek advice and emotional support. In summary, the professional life of femaleacademics in face to face settings is marked by significant challenges related to the lack of institutional support policies and expectations of productivity and academic excellence. However, female academics utilize effective time management and family care strategies to address these challenges and achieve a balance between their work and family life

    Percepción masculina de la mujer académica y equidad de género

    Male perception of academic women and its impact on gender equity in the university work environment is a transcendental topic addressed in the research project "TRAJECTORIES INTRALABORAL AND EXTRALABORAL OF THE ACADEMIC WOMAN IN TELEWORK AND PRESENT MODALITY; FROM A GENDER PERSPECTIVE” approved by Resolution No. UTA-CONIN-2023-0229-R. The main objective is to analyze the male perception towards female teachers and researchers and their influence on equal opportunities at the Technical University of Ambato. For this purpose, a qualitative methodology was used, combining analytical, deductive, exploratory, descriptive and explanatory approaches, applying dogmatic, sociological, philosophical and historical-legal research techniques. The obtained result was a document of critical legal analysis that delves into this subject. Although great progress has been made in the valuation of women's academic abilities, with more positive male perceptions compared to previous periods, especially in careers involved the social area, conclusions highlight that certain stereotypes and unconscious biases still persist towards women in technical careers, which hinders their equal access to job opportunities and leadership positions in the university environment. In addition, gender gaps were detected in certain areas and isolated cases of discrimination or unequal treatment. Consequently, it is recommended to implement sensitization and awareness programs on gender equity, as well as to design institutional policies with a gender focus that promote true inclusion. It is also suggested to establish accessible complaint mechanisms, encourage greater female representation in leadership positions and carry out periodic evaluations that lead to a continuous improvement plan towards a fully equitable organizational culture within higher education institutions. These measures are fundamental to create a truly egalitarian academic environment, where women can develop their potential without facing unjustified barriers or limitations, thus contributing to the progress and intellectual enrichment of institutions and society in general

    Análisis de la Normativa Civil y Familia: Un Estudio Estocástico con Enfoque de Género

    In this research work, an analysis of the civil and family regulations was carried out from a gender perspective, which is a topic of great importance nowadays, due to the struggle that has been generated worldwide and in Ecuador for the demand of fair rights, with the objective of achieving a more transparent and equitable gender equality, in order to promote rights and principles for the benefit of the community. It focused on understanding how civil and family regulations can perpetuate gender inequalities in society, examining all the titles that make up the Civil Code in its first book; for which the qualitative approach was used, through documentary and experimental research; This helped to identify inequalities and gender stereotypes still existing in the legislation, obtaining basic conclusions on the structure of the Ecuadorian civil regulations, with the motive, to provide a critical-propositive, determined and impartial vision on all legal provisions, highlighting the need to review and update the legislation, to ensure equal rights and opportunities for all people, regardless of their gender identity. This research offers a significant contribution to the academic field and provides a solid basis for the implementation of legal and policy changes that promote a more inclusive society; it also lays the foundation for future research with the purpose of continuing to advance towards full gender equality.

    El juicio ordinario de daño moral y la sanción pecuniaria.

    ABSTRAC. This research work has the purpose of the analyzing the disproportionality that exist between the moral damage committed, the right violated and the pecuniary sanction that is applied to the aggressor and the pecuniary compensation that is compensated to the aggressor by way of reparation, in such a way that the Constitution norm and the civil substance rule (Civil Code) have a correct application. Understanding this disproportionality does not enter the fault, but rather between the rights violated and the sanction applied, that is to say that in an assessment in witch the percentage of money that a person to receive for the moral damage that equality is the real equality for example the right of the president of Ecuador have the same of de right of the other people. Understanding the moral, honor, good name, credit of people as a fundamental right.

    The graduation work: "THE PRINCIPLE OF EQUAL RIGHTS AND TENURE PREPUBERTAL IN JUDICIAL COURT UNITH FAMILY, WOMEN, CHILDREN AND ADOLESCENTS Based in Ambato Canton", this research project has generated as a result of the great controversy between divorced parents because of the problems in society, resulting in the struggle of parents to be with their children, even against the law and certain taboos to love, care and protection of the parents is not limited to a simple weekly visit and not to be seen as an entity that issues money, is each month to pay the pension, under penalty of going to prison. After the investigative work, it is concluded that after divorce or separation the judge decides by the Ecuadorian Civil Code establish the care of children should be left to the mother when in between there is a separation, without being considered the father. Thus, usually the father only thing left is the "right to visit" for the time and conditions set by the judge.For this reason it has been chosen as a research topic unequal rights of each parent against direct custody of children under age giving the possibility that parents have the same rights as mothers to have direct custody of her children. Under these parameters, one can say that this research is of vital importance and significance, as it seeks to provide an alternative solution to the problem, which is of vital importance to be placed in our legal system to protect and forewarn the best interests of parents, children of our country.

    This research is based primarily on ensuring the principles established in the Constitution of the Republic of Ecuador taking into account the principle of equality which is established in international treaties and cannot be violated by anyone. The Constitution of the Republic of Ecuador is the supreme law of the country that protects the rights of people thus providing assurance to citizens. In tax matters in Ecuador the collection of taxes is done in two ways either by the Normal Regime and Tax Simplified Regime of Ecuador (RISE) this thesis is based on how the tax system simplified Ecuador (RISE). Violates the principle constitutional equality taking into account that this regime was created in order to improve the tax culture of the country and regulate the informal sector Speaking of tax culture refers to people pay taxes according to income produced by their economic activity taking into account that paying no actual taxes is not the intended purpose of the tax authorities but to implement this special regime, which has caused it is that the principle of equality being affected by differential treatment between taxpayers and allow evade the real tax The Tax Administration considers that this is a way for small businesses, pay taxes through monthly installments but people of normal regime have the same incomes have been adversely affected as they have had to pay a higher value to taxpayers Tax Simplified regime of Ecuador (RISE) against this fact is not taking into account the violation of the principle of equality means that all people are equal regardless of any reservations, speaking of qualification is no privilege in any way and this includes paying taxes.

    El reconocimiento legal de los grupos transgeneros y el derecho a la identidad

    This is the work in the form of graduation thesis entitled: “LEGAL RECOGNITION OF THE TRANSGENDER GROUPS AND THE RIGHT TO IDENTITY”, it proposes that transgender groups recognize their right to identity, and thus have equal rights and are not discriminated against by their individual conditions. In the investigation it was determined that transgender groups are not recognized legally, because the document proving the identity of a person in the State of Ecuador, is the certificate of citizenship, which is impossible to have information according to these groups, there is no agreement with the physical changes that can accommodate a person throughout his life, which prevents them from having an identity defined according to their appearance. So they have left an open door to continue looking into whether all people have equal rights, and whether they are being violated, although are embodied in Ecuadorian laws. Under this consideration, one can say that it is of vital importance in research as it seeks to provide an alternative solution for transgender groups, have an identity, are not discriminated against because of their gender acquired, because they have a number of injuries, guaranteeing the rights established in the Constitution, the supreme law of the Ecuadorian legal system.

    El acceso a la salud de los grupos de atención prioritaria y el principio constitucional de igualdad real y formal

    Para la mayoría de las legislaciones, si no es posible mencionar a todas, consideran a la salud como un derecho fundamental al que todos los grupos humanos tienen acceso en igualdad de condiciones y universalidad. Al ser la salud un derecho garantizado por el estado, es este quien debe brindar las prestaciones y facilidades en forma de un sistema de salud público. Los diversos grupos humanos, son los beneficiarios del sistema de salud y a quienes se les debe garantizar el pleno acceso a la misma; los grupos de atención prioritaria, vulnerables o incluso llamados relegados en algunos casos, son una realidad global sujeta a tendencias especiales en el tratamiento de la salud, debido a las peculiaridades que encierran y sobre todo a la premura en la atención. La eficacia de los sistemas de salud, es fundamental para garantizar este derecho, pues es importante trasladar a la realidad las disposiciones vigentes en las leyes y códigos, creando los medios necesarios que permitan llevar una igualdad formal a un nuevo nivel conocido como igualdad real o material, debido a que solo así se logrará un acceso a la salud óptimo, integral y sobre todo, que aporte y construya a una sociedad más justa en la que primen siempre los derechos de los seres humanos. La salud, es un derecho fundamental y como tal, se tiende a garantizarlo mediante normas y leyes que afirmen el libre acceso, gratuidad y sobre todo universalidad en los servicios. En la actualidad, ha quedado demostrado que en la mayoría de servicios públicos, la tipificación de la norma en la que se especifica la forma de prestación así como los aparentes servicios o facilidades, no es suficiente para garantizar el correcto y cabal acceso. A esta afirmación, se suma el caso del acceso a la salud, que como servicio público ha sido cuestionado por décadas y ha arrastrado hasta la actualidad fisuras propias, que de una u otra manera no han permitido el libre desenvolvimiento de la autoridad sanitaria en beneficio de la población. Es por ello que, se hace necesario el estudio a fondo y pormenorizado del actual sistema público de salud, con la finalidad de corregir las inequidades que generan un sistema de igualdad formal, para que a través de la implementación de la igualdad real o material como principio rector, se alcancen objetivos concretos en materia de salud.
