Item Integración de derechos para las personas privadas de libertad del centro de privación de libertad Tungurahua n°. 1 y su incidencia en la reinserción social de la ciudad de Ambato, en el periodo 2022(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2023-03) Toalombo Chango, Santiago Martin; Romo Santana, José LuisThe present titling work with the theme: “INTEGRATION OF RIGHTS FOR PERSONS DEPRIVED OF LIBERTY OF THE TUNGURAHUA DEPRIVATION CENTER N°. 1 AND ITS IMPACT ON THE SOCIAL REINSERTION OF THE CITY OF AMBATO, IN THE PERIOD 2022”, starts from a constitutional premise where Ecuadorian citizens are creditors of all the rights contemplated in the catalog of the Constitution of the Republic of Ecuador, (2008) as well as the Human Rights established by the United Nations Organization. People deprived of their liberty or PPL are limited in certain rights such as liberty and their civil rights before society; but they continue to maintain the other rights guaranteed within the Rehabilitation Centers for Persons Deprived of Liberty, such as the right to education, food, health, work, recreation, among others. Ecuador is currently one of the countries with the most prison violence; due to internal violence due to power disputes between criminal gangs, where the lack of enforcement mechanisms by the Ecuadorian State for the guarantee of the right to life, security, and physical integrity within the Social Rehabilitation Centers for persons deprived of Liberty. The National Service for Comprehensive Care for Adults Deprived of Liberty and Adolescent Offenders - SNAI, as well as the National Police are the entities in charge of providing security within prisons, in recent years their work has been seen poorly, making visible the social achievement that people deprived of liberty live today, placing them in a state of vulnerability within the centers established for the fulfillment of custodial sentences. The international human rights entities play a preponderant role in the investigation since they grant important precepts of application as measures to counteract the prison crisis that Ecuador is experiencing todayItem La aplicación de la justicia Indígena y la vulneración de Derechos Constitucionales(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2018-03) Cañar Barreara, Marcelo Alejandro; Pazmiño Vargas, Klever AlonsoThe Constitutional Rights constitute a manifestation in the National Constitutional, of the Human Laws that have been recognized by the international legal instruments. They recognize a set of prerogatives that, in essence, constitute the recognition of the status of being human, manifested in various environments, in which it‟s essential as a sign of civility, the guarantee of a set of faculties that enable integral human development. In indigenous justice in Ecuador, by establishing itself as an autonomous jurisdiction, it implies the possibility of communities, peoples and nationalities to know, prosecute and punish those who violate those acts that violate community norms within their territories and by some member of the community. This recognition of legal plurality in Ecuador is a step forward in the recognition of ancestral cultures, but in terms of rights for those involved, it poses a challenge to the difference in the ordinary indigenous worldview. Thus, the absence of written norms, typical of the rights of these peoples, which is transmitted orally from generation to generation, manifests a set of restrictions on constitutional rights in the prosecution of the violator of the rules, such as the presumption Of innocence, the possibility of proposing evidence, access to defense, proportionality between offense and punishment, so that, in many cases, it contradicts the exception to that jurisdiction. It recognizes the proper administration of indigenous justice, but provided that the human rights recognized in the Constitution and international legal instruments aren‟t violated, an issue that will build the central theme of this study.Item El Derecho de alimentos en las personas con enfermedades catastróficas y los derechos garantizados en la constitución(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2017-11) Miranda Cordovilla, Chrystian Santiago; Montero Solano, Juan PabloThis ongoing investigation carries the theme "THE RIGTH OF FOOD IN PEOPLE WITH CATASTROPHIC DISEASES AND THE RIGHTS GUARANTEED IN THE CONSTITUTION ". This research is in response to the need to create a legal basis to contribute to the problems and needs of people with catastrophic illnesses on the fact of providing the right food, that is when the person suffering the catastrophic illness has obligor quality in the province of Tungurahua. Constituting a topic of interest for society as a large percentage of the population suffers from these diseases whether these congenital or acquired. Solutions to the existing problems is proposed, after making a profound social analysis of population conducted in the Courts or Judicial Units of Family, Women, Children and existing Adolescents in the province of Tungurahua, Ambato City, the same that is directly related with the research topic, in order to have a deeper and successful, in their view violated rights. This research proposes a reformatory law to certain articles of the Code of Children and Adolescents regarding the chapter on the right to food, the same that safeguards the group of priority such as people with catastrophic diseases in the sense of fairness and proportionality , watch and then assert their constitutional rights, and other benefits set out in international law and treaties, constituting a national policy in which people with catastrophic illnesses can exercise all their rights among the legal certainty.Item Calidad de servicio de transporte público urbano y los derechos constitucionales de los adultos mayores en el Cantón Latacunga(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales , Carrera de Derecho, 2016-11) Soria Altamirano, Germán Alejandro; Cortés Naranjo, Edwin WilfridoIt has become customary to overlook concerning the violation of constitutional rights of the elderly, for that reason this research with which it is seeking a solution to the constant violation of these rights in urban public transport was conducted to which declare that the principal obligation in improving urban transport services is the responsibility of transport operators, users sectional authorities and urban service units; often they are leaving aside the constitutional rights of the elderly. People over sixty-five years of age are constitutionally considered as belonging to the group priority therefore is paramount duty of the state to guarantee their rights, as such rights of older adults fall within the catalog of human rights economic, social and cultural rights; It should be mentioned that the aim of the present research is to solve a problem that afflicts the latacungueña society especially the elderly who do not receive a good service from companies urban public transport, for which at the end of research work was carried out as proposed creation of an ordinance regulating and improving urban public transport in Latacunga canton for seniors, in order to seek ways or mechanisms to support compliance and respect for the rights of the elderly in this service, "Certain groups suffer disproportionate harm in respect of any violation of their human rights, for example, income groups, the disabled, the elderly, among others." (Directrices de Martricht, 2000, p. 4).Item Los delitos de violencia psicológica contra la mujer o miembros del núcleo familiar y la prueba para su juzgamiento(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales , Carrera de Derecho, 2016-10) Sánchez Cunalata, Froilan Simeón; Pazmiño Vargas, Kléver AlonsoThe research paper entitled " Crimes of psychological violence against women or members of the household and the test for trial ", performs a comprehensive analysis of the substantive and procedural standards including respect Penal Code Organic of judgment and punishment of crimes of domestic production psychological violence, as well as the principles, rights and guarantees provided in the Constitution of the Republic of Ecuador and other legislation for the care and protection of victims. solutions to the existing problems is proposed, after making a profound social analysis of population made in existing gerontology centers in the province of Tungurahua, as well as their cantonal councils for the protection of rights, the same that is directly related to the research topic, in order to have a deeper and more accurate view, in terms of their violated rights and the dangers they are exposed on the streets to beg, all with the desire to contribute purposefully to recovery immersed in this problem humans. Through extensive theoretical and field research it found that the application of a single interview violates the rights of the victim in crimes of psychological violence; the problem is caused because when performing a single interview the test is not sufficiently clear which requires that require rapid , effective and timely intervention by the administration of justice , attention to proper procedure to its length and complexity is not able to offer. The importance of psychological violence as a social problem and the alarming incidence figures and impunity in our country, which have been evidenced in several official studies applied nationally, are the impetus for the development of this research, which aims provide an alternative solution to the problem through a reform that ensures respect and effective protection of the rights of victims of psychological violence in processing and punish these crimes in the most appropriate manner.Item Los derechos constitucionales y la mendicidad en los adultos mayores(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales , Carrera de Derecho, 2016-06) Tamayo Flores, Cristian Gabriel; Espin Meléndez, María CristinaThis research is in response to the need to create a legal basis to contribute to the problems and needs in older adults who have made begging their way of life in the Tungurahua Province. For society this is an interesting topic as every human being moves toward the same destination, as old age. This proposed some solutions to the problem. After making a deep social analysis the dwellers in the gerontology centers in the Tungurahua Province, as well the cantonal councils for the protection of the rights. In order to know if their rights were violated or as we as to the dangers their faces on the streets to beg. This research proposes to create a Provincial Ordinance, the same that protects the rights of the elderly people as they need priority attention and constitutional benefits, in the cantons of the Tungurahua Province. Establishing some provincial–level regulations for elderly people that can benefit them in everything.Item La huella hídrica del río Cutuchi y el derecho al acceso seguro y permanente a alimentos sanos, suficientes y nutritivos en la zona del canal Latacunga Salcedo Ambato(2015) Villacreses Hidalgo, Karen Jazmín; Pazmiño Calderón, María IsabelEl desarrollo de las ciudades o asentamientos humanos, a la par que significa crecimiento socioeconómico también representa deterioro del medio ambiente, tema que en la actualidad adquiere importancia de sobre manera al incorporar la Constitución de 2008 la expresión Sumak Kawsay, para hacer relación al equilibrio que debe existir entre la actividad del hombre y la naturaleza, la que en el texto constitucional es considerada como sujetos de derechos, de ahí el calificativo de que la Constitución de la República del Ecuador es eminentemente naturalista o protectora de los derechos de la naturaleza. Toda actividad desarrollada por el ser humano por simple que parezca, de acuerdo al criterio de los especialistas en materia ambiental causa detrimento o impacto al medio ambiente, de manera particular aquellas actividades que se efectúan en la zona por la que atraviesa la Huella Hídrica del Río Cutuchi, las cuales, causan contaminación de sus aguas y por consecuencia de los productos agrícolas (alimentos) producidos en la zona, mismos que al ser consumidos por la población local y nacional producen afectaciones graves en la salud. La contaminación tanto de las aguas como de los productos agrícolas cultivados en la zona, se origina por las descargas de desechos sólidos, líquidos, gaseosos, etc. Procedentes de las actividades ya señaladas, provocan la violación del derecho al acceso derecho al acceso seguro y permanente a alimentos sanos, suficientes y nutritivos consagrado en el texto constitucional y otros ordenamientos infraconstitucionales que regulan en materia ambiental y de salud. No obstante la existencia de normas jurídicas orientadas al control de la contaminación ambiental y al establecimiento de sanciones para los infractores. Es necesario que los organismos gubernamentales de naturaleza seccional participen activamente en dicho control mediante la formulación de planes, políticas y programas en materia ambiental, en uso de las facultades atribuidas por el Código Orgánico de Ordenamiento Territorial Autonomía y Descentralización.Item Las obligaciones subsidiarias en el juicio de alimentos y los derechos del adulto mayor(2015) López Tamayo, Luis Rolando; D-T. Sánchez Villalva, Cecilia MonserrateEn nuestro país es fácil pasar por alto todo lo concerniente con la vulneración de derechos, es por eso que he realizado esta investigación con la cual tratando de poner una solución a la vulneración de los derechos de los adultos mayores sin que esto afecte al interés superior de los niños, niñas y adolescentes, para lo cual manifestamos que la obligación principal en los alimentos la tienen los padres que son los parento-filiales, mas no los demás que en el caso del articulo innumerado 5 manifiesta como son los abuelos, hermanos y tíos , para lo cual muchas der la veces se dejaba de lado tanto los derechos constitucionales como los derechos internacionales de los adultos mayores. El derecho a la alimentación establece una garantía jurídica del ciudadano que, por tanto, puede reclamar su satisfacción a quien la debe propiciar. Por este motivo el derecho a la alimentación se inscribe dentro del catálogo de derechos humanos (económicos, sociales y culturales). El derecho a la alimentación, por lo antes indicado, es una noción jurídica y a la vez una forma de materializar de forma concreta a favor del ciudadano lo que la soberanía alimentaria establece como meta social. Así como hablamos del derecho alimentos podemos hablar del derecho de los adultos mayores y sus derechos los mismos que son aquellas condiciones instrumentales que le permiten a la persona su realización, En consecuencia subsume aquellas libertades, facultades, instituciones o reivindicaciones relativas a bienes primarios o básicos que incluyen a toda persona, por el simple hecho de su condición humana, para la garantía de una vida digna, sin distinción alguna de raza, color, sexo, idioma, religión, opinión política o de cualquier otra índole, origen nacional o social, posición económica, nacimiento o cualquier otra condición”. Se trata de evidenciar lo más favorable para los adultos mayores, abuelos sin que este afecte al interés superior del menor mediante la creación de un bono de desarrollo humano.Item El despido intempestivo vulnera los Derechos Constitucionales de los trabajadores estudio realizado en la inspectoría de trabajo de Tungurahua en el periodo enero marzo del 2011(2012) Ortega Poaquiza, Pablo AlejandroEl presente trabajo se desarrolló sobre el siguiente problema “El Despido Intempestivo Arbitrario Vulnera Los Derechos Constitucionales de los Trabajadores estudio realizado en la Inspectoría del Trabajo de Tungurahua en el periodo Enero Marzo del 2011” Al investiga y desarrollar el Marco Teórico la investigación fue tornándose compleja, sin embargo sirvió para ir buscando la información que en verdad era de utilidad a la problemática planteada. Razón por la cual la investigación se hizo más intensa hasta obtener material de relevante importancia. Otro aspecto crucial fue el momento en el que se llevó a cabo las encuestas las mismas que al ser desarrolladas, analizadas y respectivamente tabuladas se obtuvo resultados que sirvieron para fundamentar las respectivas conclusiones y recomendaciones que se exponen más adelante. Si partimos de las palabras de Elbert Hubbard (1856-1915) Ensayista estadounidense “Una máquina puede hacer el trabajo de 50 hombres corrientes. Pero no existe ninguna máquina que pueda hacer el trabajo de un hombre extraordinario.” Es importante dar la importancia a la mano de obra y es mejor no arriesgarse a perder el talento humano. Se cuidó minuciosamente la Bibliografía para que la misma guarde relación con los aspectos tomados en consideración, en materia laboral. El análisis de los datos se llevó a cabo con la seriedad que el caso amerita, pudiendo hacer posible conclusiones adecuadas y certeras a la realidad actual.
