    El juicio ordinario de daño moral y la sanción pecuniaria.

    ABSTRAC. This research work has the purpose of the analyzing the disproportionality that exist between the moral damage committed, the right violated and the pecuniary sanction that is applied to the aggressor and the pecuniary compensation that is compensated to the aggressor by way of reparation, in such a way that the Constitution norm and the civil substance rule (Civil Code) have a correct application. Understanding this disproportionality does not enter the fault, but rather between the rights violated and the sanction applied, that is to say that in an assessment in witch the percentage of money that a person to receive for the moral damage that equality is the real equality for example the right of the president of Ecuador have the same of de right of the other people. Understanding the moral, honor, good name, credit of people as a fundamental right.
