    This research paper titled: "The Superior Interest of the Child and the Surrender of Accounts of the Payment of the Alimony in Pensions that Surpass a Basic Unified Salary", focuses on problems that arise between the parents, when in the processes of Alimony pensions the arrangement is a high amount. And when the person who provides that pension believes that it is not intended for their children’s necessities. Nowadays, in Ecuadorian legislation the figure of accountability does not apply in the alimony processes so that when this kind of problems arise, there is no legal way to solve it. When considering the legal vacuum now is the consideration, the lack of this legal figure in alimony processes, leads to the violation of the principle of Higher Interest of Children, and it has been shown that in many cases where there is A high maintenance alimony, these resources are not used in favor of the welfare of children, who are holders of the right to food. Implement the legal framework of accountability in alimony processes, apply the specific parameters in the Childhood and Adolescence Code, promote the proper use of it and with and with them the respect for the principle of best interest of the child is protected.
