Item El cobro judicial de tarjetas de crédito y el principio de celeridad procesal(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2021-11) Herrera Córdova, Jhajayra Yamilex; Vásconez, José LuisThis research deals with the judicial collection of credit cards and its incidence on the principle of procedural celerity, due to the fact that there are few cases resolved within the jurisdictional body in relation to the topic, it was approached from a qualitative approach since it is impossible to measure the problem in a quantitative way, being necessary to focus on a descriptive, exploratory and field research, which allows enriching and expanding the knowledge of the researcher through the criteria provided by the subjects directly involved both in the administrative and judicial sphere. The bibliographic documentary methodological technique contributed in the storage of information on comparative law sources, which glimpsed the need of applicable norms to this aspect mainly related to the defense of credit card holders, later interviews were conducted with Legal Coordinators of Financial Entities and Judges of the Civil Judicial Unit of Ambato specialists in the Civil branch, therefore they enjoy a vast knowledge regarding contracts and monetary obligations regardless of how they have been contracted, so their insights provided a relevant contribution in the research that was developed. It is necessary to emphasize that the central nucleus of this research work is to determine how the judicial collection of credit cards affects the principle of procedural speed, which is not fulfilled since there is no reliable process that guarantees the rights of the parties and the access to an expeditious justice, without delays.
