    Las apuestas deportivas digitales: un análisis comparativo con la legislación colombiana

    This research focuses on the analysis of digital sports betting and its lack of regulation in Ecuador, highlighting its operation without any type of control, so the interest of this research work is to investigate the main effects or problems that arise from the excessive use or consumption of digital sports betting, as well as to establish the possible effects on the rights enshrined in the Constitution of the Republic of Ecuador. In addition, a descriptive-correlational analysis is established based on Ecuadorian and Colombian regulations in order to establish their differences in terms of the regulation of digital sports betting, as well as the concept that each one handles with respect to this activity. The methodology employed includes the use of inductive and exegetical methods to analyze the legal regulations of Ecuador and Colombia, as well as a qualitative approach to understand the legal and social context of digital sports betting in both countries; interviews were also used as a data collection technique, and the selected population included experts in criminal law, psychology professionals and digital sports betting users. One of the justifications underpinning this research is the interest in the exponential growth of people dedicated to this type of betting, particularly young people, as well as the normality with which this issue is approached without perceiving the consequences that it brings, so the main proposal of this research is to determine whether or not it is necessary to reform Article 236 of the Organic Integral Criminal Code in which digital sports betting is punished.
