La usura y la economía informal
(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2024-02) Caillagua Vega, Cristian Alexander; Tite, Ramiro Segundo
This research aims to address the crime of usury in the context of the informal economy in Ecuador. Given the difficulty in accurately determining the facts linked to the commission of this crime within the Ecuadorian economic sphere, the study seeks to shed light on the informal commercial sphere, examining its complications, causes and specific consequences associated with the commission of usury. The main objective is to analyze the crime of usury and its impact on the informal economy, within a quantitative approach, since private informal sellers were individually surveyed. On the other hand, the aim is to explore and understand the complexities inherent to this unregulated commercial area, identifying the factors that promote the practice of usury and evaluating the repercussions that this has on society and the Ecuadorian economy. Likewise, the research is based on the rigorous analysis of the norms established in Ecuadorian legislation related to usury, which will allow not only to identify deficiencies in the current regulation but also to propose possible solutions and legislative improvements that strengthen the capacity of the legal system. to effectively address and prevent the crime of usury in the informal economy, therefore the results of this research will provide a deeper understanding of the dynamics between usury and the informal economy, serving as a basis for the formulation of public policies and legal strategies more effective, in addition to contributing to the development of preventive and corrective measures that help mitigate the negative impacts of usury on the economic and social stability of Ecuador
