dc.descriptionLa capacidad legal del menor adulto emancipado es un tema de amplia discusión, ya que se produce una emancipación ineficaz, donde el menor adulto emancipado no puede obrar independientemente como establece la ley originándose una antinomia normativa, que impide cumplir uno de los objetivos principales de la emancipación y lo que determina el Art. 266 del Código Civil mismo que es obrar independientemente. En el desarrollo del presente trabajo, estudiaremos y analizaremos el origen de la emancipación, sobre la capacidad que se le otorga al menor adulto emancipado, como se ve afectado en su desarrollo como persona y ciudadano; y se realizara una comparación con otras legislaciones del mundo. El Art. 266 del Código Civil nos estipula que el hijo emancipado tiene derecho a obrar independientemente, sin embargo, si el menor adulto emancipado desea realizar un acto comercial de manera independiente, este no lo va a poder realizar o dicho acto no será considerado eficaz, debido a que el Código de Comercio establece en su Art. 9 que el menor adulto emancipado para poder realizar actos de comercio necesita de la autorización de un tutor o curador, surgiendo así una contradicción jurídica-normativa.es_ES
dc.description.abstractThe legal capacity of the emancipated minor adult is a subject of wide discussion, since there is an ineffective emancipation, where the minor emancipated adult can’t act independently as established by the law, giving rise to a normative antinomy, which prevents fulfillment of one of the main objectives of the law. emancipation and what determines Art. 266 of the Civil Code itself that is to act independently. In the development of this work, we will study and analyze the origin of emancipation, about the capacity that is granted to the emancipated minor adult, how it is affected in his development as a person and citizen; and a comparison will be made with other legislations of the world. Article 266 of the Civil Code stipulates that the emancipated child has the right to act independently, however, if the emancipated minor wants to perform a commercial act independently, he or she will not be able to do it or said act will not be considered effective , because the Commercial Code establishes in Art. 9 that the minor emancipated adult to be able to perform acts of commerce needs the authorization of a guardian or curator, thus creating a legal-normative contradiction.es_ES
